Privacy and Information Handling Notice

We are Robert Walters New Zealand Limited and operate within a group of companies ultimately owned by Robert Walters Plc and trading under the Robert Walters brand (“Robert Walters”). 

Robert Walters provides the following “Services”:

  • specialist recruitment services, placing candidates on a permanent, contract, and temporary basis across a range of industries and geographies (“Recruitment Services”);
  • business process outsourcing services assisting companies with their permanent recruitment, temporary recruitment, contingent workforce solutions, supply chain and labour supply, commonly known as ‘RPO’, ‘MSP’ or ‘Service Procurement Desk Services’ (“Outsourcing Services”); and
  • other consultancy, technology and advisory services related to recruitment, including but not limited to market intelligence, future of work and talent development (“Advisory Services”).

 

References to “we,” “us,” and “our” are references to Robert Walters.

We write to inform you about how we handle and process your personal information in accordance with the New Zealand Privacy Act 2020 (the "Privacy Act") and the Information Privacy Principles (“IPPs”).

 

In accordance with IPP 3A of the Privacy Act, we inform you of the following:

1. Collection of Personal Information

We may request that you provide us with personal information so that we can deliver our Services to you and our clients. We usually collect your personal information from you, however, we may collect your personal information indirectly from third-party sources such as job boards, pre-employment screening providers, or other publicly available channels. 

If you submit an application with us, please be advised that:

  • You guarantee that all personal information provided is complete and accurate;
  • Any failure to provide complete and accurate information may result in withdrawal as a candidate; and
  • Attempts to obtain employment or engagement through deception may result in civil and/or criminal liability, as well as immediate cancellation of assignments or termination of employment (as applicable).

 

2. Categories of personal information collected

We generally collect and handle your name, contact information (i.e. email address, postal address and telephone number) and education and employment history. Section 4 (What personal information do we collect) of our Global Privacy Policy contains a non-exhaustive list of the types of personal information that we commonly collect and use for the performance of our Services. 

3. Purpose of Information Handling

We collect personal information necessary for providing our Services. We use your personal information primarily to provide Services to our clients and you. This includes assessing your suitability for job vacancies and matching you with appropriate roles. 4. Review of Personal Information

Our employees will review your job application before submitting it to our client(s). As part of this process, we, our clients, or agents acting on our behalf may need to confirm the information you have provided. This may include:

  • Contacting Academic Providers: Your academic institutions may require your approval before releasing details of your achievements to us, our clients, or agents.
  • Contacting Current Employers: Before contacting your employer, we will: 
    • ensure that you have resigned or terminated your employment (as applicable); and
    • obtain your consent before proceeding.

 

5. Disclosure and Transfers

We disclose personal information only when permitted by law and will always seek your prior approval before introducing it to clients. Due to the global nature of our business, transfers outside New Zealand may occur but will be subject to appropriate safeguards in line with and the requirements of IPP 12 regarding cross-border disclosure. Section 14 (Personal data storage and transfer) of our Global Privacy Policy contains further details on data transfers.

6. Retention of Personal Information

We retain your personal information only for as long as necessary to fulfil the purposes for which it was collected. Given our commitment to supporting your career over time, we may retain your data beyond a single placement if we reasonably believe there is an ongoing relationship with you. For more details on retention practices, see section 9 (Data Retention) of our Global Privacy Policy.

7. Technology Use

We will always use your personal information in accordance with our obligations under the Privacy Act and IPPs.  We may occasionally use technological tools when processing applications - for example, filters to sort through applications we receive and to that match candidates with specific roles based on their qualifications. If technology plays a significant role in assessing your application, we will inform you accordingly.

8. Your Rights Under the Privacy Act

Under the Privacy Act, you have rights regarding your personal information, including:

  • The right to access your personal information;
  • The right to request corrections to inaccuracies;
  • The right to know how your personal information is being used; and
  • The right to complain if you believe we have breached the Privacy Act.
